1. Agreement to Terms

Welcome to the website of Bawarchi Scarborough (“Bawarchi”, “we”, “us”, or “our”), located at 1949 Kennedy Rd, Scarborough, ON M1P 2L9. By accessing or using our website (https://bawarchiscarborough.ca), browsing our menu, requesting catering packages, or utilizing any affiliated digital services, you agree to be bound by these Terms of Use and our Privacy Policy.

If you do not agree to these Terms, please do not use our website or services.

2. Online Ordering & Third-Party Integrations

To provide efficient service, online takeout and pick-up orders are processed via our authorized point-of-sale partner, Toast POS (Toast Tab). Delivery orders may also be facilitated through third-party platforms including Uber Eats and DoorDash.

• When placing an order through Toast Tab or delivery aggregators, transactions are governed by both these Terms and the applicable terms and privacy policies of the third-party provider.
• Menu prices, item availability, and delivery fees are subject to change without notice. In the event of a technical discrepancy between pricing shown on our marketing website and Toast Tab checkout, the price confirmed at checkout shall govern.
• Cancellations or modifications to online food orders must be submitted immediately by calling the restaurant directly at 416-479-6299. Once preparation has commenced in our kitchen, orders cannot be canceled or refunded.

3. Catering Packages & Event Bookings

We provide catering services for private, corporate, and wedding celebrations. The following terms apply to all catering arrangements:

• Quotes & Estimates: Online catering package descriptions and per-person estimates are starting prices. Official catering confirmations require a tailored quote agreed upon in writing by our catering coordinator.
• Guest Counts: Catering packages stipulate minimum guest counts (typically 20 guests for standard packages). Final guest count guarantees must be confirmed at least 72 hours prior to the scheduled event.
• Deposits & Payments: A deposit is required to secure the catering date. Final balances must be settled according to your written catering agreement prior to or upon delivery/service.
• Cancellations: Due to food procurement and advance preparation timelines, catering cancellations made within 72 hours of the scheduled event may be subject to forfeiture of the deposit.

5. Intellectual Property Rights

All materials on this website, including but not limited to the Bawarchi brand logos, dish photography, graphics, textual descriptions, menus, and software code, are the intellectual property of Bawarchi Scarborough or its content suppliers and are protected under Canadian and international copyright and trademark laws.

You may access and download materials solely for personal, non-commercial dining and catering evaluation. Any reproduction, redistribution, or commercial exploitation without our prior written consent is strictly prohibited.

6. Disclaimers & Limitation of Liability

This website and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the fullest extent permissible by applicable law in the Province of Ontario, Bawarchi Scarborough, its owners, directors, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use this website, service interruptions, delivery delays caused by third-party carriers, or inaccuracies in posted digital content.

7. Governing Law & Jurisdiction

These Terms of Use and any disputes arising out of or related to your use of this website or catering agreements shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding shall be instituted exclusively in the courts of the Province of Ontario located in Toronto.
